'Ngó Lơ' Cho 2 Công Trình Vi Phạm, 11 Bị Cáo Lãnh án Tù

Sau 2 ngày xét xử sơ thẩm, chiều 21.1, TAND TP.HCM tuyên án đối với 11 bị cáo về tội “Đưa hối lộ”; “Lợi dụng chức vụ, quyền hạn trong khi thi hành công vụ” và “Sử dụng tài liệu giả của cơ quan, tổ chức”, liên quan đến sai phạm tại 2 công trình trên địa bàn quận Phú Nhuận cũ (TP.HCM).

HĐXX nhận định căn cứ chứng cứ, tài liệu trong hồ sơ vụ án và lời khai tại tòa của một số bị cáo, đủ cơ sở xác định cáo trạng truy tố các bị cáo đúng người, đúng tội. Tuy nhiên, HĐXX dựa vào tình tiết tăng nặng, giảm nhẹ trách nhiệm hình sự; vai trò của từng bị cáo để tuyên mức án tương xứng, phù hợp.

Dùng giấy tờ giả để “phù phép” hồ sơ xây dựng

Theo cáo trạng, vụ án bắt nguồn từ những sai phạm tại công trình tòa nhà văn phòng Nam Kim Tower (số 135 Phan Đăng Lưu, quận Phú Nhuận cũ).

Để có đủ điều kiện xin giấy phép xây dựng, bị cáo Lê Khánh Cương (Phó giám đốc Công ty Hưng Quốc) đã câu kết với Nguyễn Ngọc Lâm và Nguyễn Quốc Sơn để làm giả giấy chứng nhận thẩm duyệt thiết kế về PCCC.

Mặc dù hồ sơ thiết kế PCCC thực tế bị cơ quan chức năng từ chối do không đảm bảo các tiêu chuẩn về an toàn cháy nổ (như khoảng cách PCCC, hệ thống thoát nạn, bãi đỗ xe…), các đối tượng này vẫn sử dụng tài liệu giả để nộp vào Sở Xây dựng nhằm lừa dối cơ quan quản lý nhà nước.

Cán bộ thanh tra và công an “nhận tiền bỏ qua sai phạm”

Đáng chú ý, trong quá trình thi công công trình 135 Phan Đăng Lưu, khi xảy ra sự cố sụt lún, nứt mặt đường Phùng Văn Cung, bị cáo Đỗ Duy Minh Trung (chuyên viên Đội Thanh tra cơ động thuộc Sở Xây dựng) đã lợi dụng chức vụ để nhận 100 triệu đồng và 2.000 USD từ Lê Khánh Cương. Đổi lại, Trung đã hướng dẫn đơn vị thi công lập hồ sơ đối phó và không báo cáo trung thực về vi phạm, giúp công trình không bị đình chỉ thi công.

Không dừng lại đó, sai phạm còn lấn sang lĩnh vực nghiệm thu PCCC. Các cựu cán bộ công an gồm Lý Kông Thái, Nguyễn Danh Công (thuộc Phòng Cảnh sát PCCC & Cứu nạn cứu hộ) và Huỳnh Văn Tâm (cựu Phó trưởng phòng Phòng Cảnh sát PCCC) đã bị truy tố về tội “Lợi dụng chức vụ, quyền hạn trong khi thi công vụ”.

Các bị cáo này dù biết công trình có nhiều thiếu sót nghiêm trọng về PCCC như: thay tường gạch bằng vách thạch cao, thiếu hệ thống chữa cháy tự động, cửa cuốn ngăn cháy không đạt chuẩn… nhưng vẫn ký biên bản nghiệm thu đạt yêu cầu để giúp chủ đầu tư đưa công trình vào sử dụng.

“Lót tay” cán bộ Sở Xây dựng để điều chỉnh thiết kế trái phép

Tại một diễn biến khác liên quan đến công trình 411 Huỳnh Văn Bánh (do Công ty TNHH Nha khoa Đông Nam làm chủ đầu tư), bị cáo Nguyễn Trung Cang (cựu kiến trúc sư) và Đặng Quốc Dũng (bác sĩ) đã đưa hối lộ cho hai cán bộ Sở Xây dựng là Trần Quốc Thắng và Đinh Hoàng Thiệp.

Các bị cáo tại Sở Xây dựng đã nhận hối lộ (Thắng nhận 50 triệu đồng; Thiệp nhận 10 triệu đồng cho cá nhân, và sau đó nhận thêm 60 triệu đồng chia đôi với Thắng) để thực hiện các hành vi sai phạm: Chấp thuận thẩm duyệt thiết kế cơ sở dù hồ sơ có sự mâu thuẫn về công năng sử dụng (từ sảnh chờ biến thành sảnh và bãi xe); tự ý tẩy xóa, sửa chữa bản vẽ thiết kế, thêm các cột trang trí tại tầng 9 nhằm giúp chủ đầu tư tăng diện tích xây dựng trái phép sau khi đã hoàn công.

Mức án cụ thể của 11 bị cáo:

Về tội “sử dụng tài liệu giả của cơ quan, tổ chức”, HĐXX tuyên phạt bị cáo Lê Khánh Cương, Nguyễn Ngọc Lâm, Nguyễn Quốc Sơn cùng 3 năm 6 tháng tù.
